Whether you are building a new house or
condo or buying an existing one you should always proceed with
caution.
Should I hire a home inspection on new construction?
You should always hire a qualified home inspector. Please do not
dismiss this necessity just because your home is new. Even
qualified home builders have to rely on contract labor. It has
been reported that out of the new homes being built today, 85% of new
construction has a chance of construction defects.
What else should I do to protect myself? Consider
hiring an experienced real estate lawyer to review your contract and
home warranty. If you choose to hire a lawyer, ask them to check
for an inspection contingency in your builder's contract.
Even your builder's home warranty should be subject to close scrutiny.
Your builder may warranty your home's systems, but not all states
regulate the warranty programs or post bonds to secure performance.
What if I discover a problem or defect after I move in?
All houses have problems, old or new. What becomes important
with a new house is how your builder decides to handle those problems.
Your first course of action is to review your contract and warranties
for items that's should be covered. Then, contact your builder
immediately. Continue by stating your complaint in writing as
thoroughly and accurately as you can. Next, give the builder the
opportunity to resolve your complaint. However, be mindful and
do not allow your warranties or statutes to expire while you wait.
Document your complaints with photos, copies of written agreements,
and warranties. If you didn't choose to have a home inspection
before your closing, now is the time to hire a qualified inspector.
Ask your inspector to file his findings with your builder or their
insurance company.
If your builder still fails to deliver, follow up with state
building and regulatory authorities. If all else fails, as a
last resort, you may be forced to seek legal assistance from a
qualified lawyer. Your real estate agent and/or the local bar
association will be able to help you find a lawyer who specializes in
construction-defect lawsuits.
